<p id="trying-to-be-different" class="intro">In <a href="http://en.wikipedia.org/wiki/The_Beach_(film)" title="en.wikipedia.org/wiki/The_Beach_(film)" rel="external"><i>The Beach</i></a><i> (2000)</i>, Richard was a jaded youth who had traveled far abroad to Thailand seeking something different—a unique experience—but when he got there, he realized he wasn&#8217;t the only one. In a curious series of events involving suicide and banana pancakes, he recruited a French couple and abandoned the tourist road. His case: &#8220;I just feel like everyone tries to do something different, but you always wind up doing the same damn thing.&#8221;</p>
<p id="traveler-vs-tourist">There is a fundamental difference between tourists and travelers. Mention <i>Frommer&#8217;s</i> to someone. If they cringe, then they&#8217;re a traveler. If not, then they&#8217;re a tourist. Travelers want to get lost. They want to leap into the unknown and experience the world as it is. Tourists want the greatest hits. Is <a href="http://hypem.com/" title="hypem.com" rel="external">The Hype Machine</a> the <i>Frommer&#8217;s</i> of music blogging? Is <a href="http://elbo.ws/" title="elbo.ws" rel="external">Elbo.ws</a> the <i>Lonely Planet?</i> Is <a href="http://mog.com/posts" title="MOG Music Network" rel="external">MOG</a> the <i>Fodors</i>? How would Richard ditch the map and escape the virtual beaten path through the music blogosphere?</p>
<p id="taste-is-perception">If online music journalism was controlled by only an elite few, it would mind-numbing. Bland. Like gum from 1971. Like a rainbow in black and white. Taste is perception. It&#8217;s a point of view or a frame of mind. It&#8217;s relative. Music reviews? In ears we trust, or in <i>Rolling Stone</i>? The pre-blogosphere publishing era, where only a select few got published and got paid for it, now seems inherently degenerate. The era changed—a.k.a. progressed. Two thumbs up is now two million thumbs up.</p>

<p id="chris-weingarten-music-is-math">Rock critic <a href="http://twitter.com/1000timesyes" class="twitter-profile" title="@1000TimesYes" rel="external">Chris Weingarten</a> sees the negative flip side. He thinks The Hype Machine and Twitter have sent the masses into gravitational spin towards music mediacracy. Writing, reading, learning about music is &#8220;math&#8221;, he said <a href="http://www.ippio.com/video/5358/Criticism-II-Music-Is-Math" title="Video: Music Is Math | 140Conf | Ippio" rel="external">last April</a> at 140Conf, and &#8220;when you&#8217;re aggregating the shared tastes of thousands of people, that&#8217;s the very definition of the lowest common denominator.&#8221; He went on to point out that, &#8220;no one posts negative commentary anymore because no one Google&#8217;s for bands they don&#8217;t like.&#8221; Who wants to read about bands they don&#8217;t like? Criticism has been replaced by curation.</p>
<p id="chris-weingarten-sxsw-panel">Weingarten has actually trashed-talked web culture enough that (even to his own surprise) there&#8217;s a panel lined up for SXSW next year, called <a href="http://panelpicker.sxsw.com/ideas/view/7904" title="Curatorial Culture: The Case Against Christopher Weingarten | SXSW 2011" rel="external">Curatorial Culture: The Case Against Christopher Weingarten</a>. The argument is this: &#8220;Cultural criticism is in fact far more diverse and productive when trusted to a representative democracy. This outbreak of curators is nothing short of a revolution and should be championed by those in the business of making music.&#8221;</p>
<p>Denying change is self-defeating. Denying creativity is world-defeating. Our world is a paradox without a crash course. The streets are filled with drivers who supposedly &#8216;can&#8217;t drive&#8217; and writers who supposedly &#8216;can&#8217;t write.&#8217; Perception is all you have. Run with it.</p>

<p class="long">Before you start, determine the bands that are most similar to you. In case you&#8217;re clueless on this, use <a href="http://www.last.fm" title="last.fm" rel="external">last.fm</a> to help. Each last.fm artist page lists similar artists. It seems inefficient to do an abrupt shutdown only to have to react to counter claims, and obviously the warnings were ineffective. To set the record straight I love Google. I also love music and free content.</p>

<p id="legal-gray-area">Now if I got an email explicitly saying &#8220;you&#8217;re breaking our rules and we&#8217;re going to shut you down&#8221; then I would react immediately but apparently these bloggers missed this chance. I&#8217;m sure Blogger&#8217;s TOS states that they have the right to delete violating blogs, and to protect themselves legally they delete them. But I find it hard to believe Google didn&#8217;t warn them. I think the bloggers had to have known they were in a legal gray area. They should have exported a backup of their blog.</p>

<p id="better-solution">We need better laws surrounding internet music journalism that reflect today&#8217;s Internet behavior. We need better education regarding copyright so that writers know how to properly license intellectual property. Oftentimes music bloggers have gained permission to include mp3&#8242;s directly from the artist or their record label. The same may even go for some YouTube videos that have had their audio removed due to &#8220;copyright infringement.&#8221; Is anyone asking the artists or contacting the uploader first? Who exactly is making the complaints? Theoretically the <a href="http://en.wikipedia.org/wiki/Digital_Millennium_Copyright_Act" title="Wikipedia: DMCA">DMCA</a> criminalizes anti-DRM tactics and copyright infringement. In practice, is it working—or rather—is it worth it?</p>

<blockquote id="communication-breakdown" class="indent"><p>From what&#8217;s being talked about from the blogs that did have their content removed, it sounds like the newer system (unlike the old system) did alert them to what was happening, but they just felt hopeless to respond. Google has put up a response, basically saying that if it doesn&#8217;t receive a counternotice, and it keeps getting DMCA takedowns on the same account, eventually it takes the blog down as a &#8220;repeat offender.&#8221; So we&#8217;re back to the point that I predicted in August, where your average everyday blogger has no idea what a DMCA counternotice is and how to use it &#8212; so it would be much better if Google made the process of filing such a counternotice a lot more intuitive. <p id="tips-to-avoid-infringement">In order to prevent any legal confusion, I would include a disclaimer making it painfully obvious that that the artist (or label) gave permission to have the mp3 on the blog. Even better, I would use legal embedding tools such as <a href="http://bandcamp.com" title="bandcamp.com" rel="external">Bandcamp</a>, <a href="http://soundcloud.com/tour/widgets" title="Soundcloud » Widgets" rel="external">Soundcloud</a>, or <a href="http://grooveshark.com" title="grooveshark.com" rel="external">Grooveshark</a> as opposed to a direct link to an .mp3 file. This saves bandwidth and covers your a**. In the case of Bandcamp, you would be helping the artist because Bandcamp downloads usually require an email address and ZIP code giving bands a direct connection to their fans and valuable location data. I think most Bandcamp artists would happily issue free download codes to mp3 bloggers. Another route would be to use <a href="http://creativecommons.org" title="creativecommons.org" rel="external">Creative Commons</a>-licensed content—there&#8217;s plenty of CC-licensed content on <a href="http://jamendo.com" title="jamendo.com" rel="external">Jamendo</a>.</p>

<p id="wordpress-and-other-platforms">All that said, the best solution is to set up a blog on your own domain with an opensource blogging platform like <a href="http://wordpress.org" title="wordpress.org" rel="external">WordPress</a>. But even still you should backup your posts. Blogger and WordPress both support exporting (backing-up) into a transferable .xml file. Mini-blogging platforms <a href="http://tumblr.com" title="tumblr.com" rel="external">Tumblr</a> and <a href="http://posterous.com" title="posterous.com" rel="external">Posterous</a> are also good free alternatives—Posterous supports transferring from another blog but I don&#8217;t think Tumblr does yet. See Mashable&#8217;s head-to-head <a href="http://mashable.com/2009/06/29/posterous-vs-tumblr/" title="Posterous vs. Tumblr: A Head to Head" rel="external">comparison</a>. <a href="http://squarespace.com" title="sparespace.com" rel="external">Squarespace</a> is a paid service that supports importing and is also worth considering as an out-of-the-box solution.</p>

Buy your hosting separately from your domain though—most domain registration services offer cheap hosting that sucks as an upsell. It&#8217;s worth paying for good hosting. Of course the DMCA could issue a complaint to you through you or your host, but it&#8217;s less likely and the complaint would be more direct to you and not through a 3rd party.</a></p>

<p id="google-and-china"><span class="s150">Google and China.</span> Google&#8217;s motto is &#8220;Don&#8217;t be evil.&#8221;</span> While often times in life a <a href="http://virtualmusic.tv/2009/10/modern-moral-values-black-white-or-gray/" title="Modern Moral Values—Black, White, or Gray?">fine line</a> exists—I can&#8217;t help but view internet censorship on the dark side. I hope that Google continues to act proactively against internet censorship in China, and the world. Unbiased information is fundamental to social and intellectual progress. People can handle the truth. Blocking sites means blocking progress. Attempting to &#8220;control&#8221; the Internet defies logic. Privacy and security are huge issues.</p>

<p class="reverse" style="margin-bottom:0"><span class="s150">Counter-censorship technology.</span> One could argue that censorship inhibits innovation. But censorship has <i>forced</i> people to invent counter-censorship technologies. Imagine what bright determined minds could be inventing without being held back by internet censorship.</p>
<blockquote class="indent-reverse nyt reverse-y"><p>More than a million people in China, including human rights activists and expatriates, are using special software to circumvent the nation’s complex online censorship system, known as the “Great Firewall.” This has created a booming market for software companies, which are capitalizing on the growing desire of China’s Internet users to fanqiang, or scale the wall, to visit Web sites like Facebook, YouTube and Twitter. <p id="lets-not-be-clueless"><span class="s150">Let&#8217;s not be clueless.</span> In my opinion censoring information—whether by government, institution, workplace—is an ultimate form of disrespect. I take it personally. If the question is &#8220;why&#8221; then is the answer &#8220;fear?&#8221; Are censors afraid of people&#8217;s reaction to the truth? Here&#8217;s the bright side—think about traditional news mediums like television, radio, or newspaper, and realize that the Internet is by far the most democratic and unbiased information medium in history. That&#8217;s the whole point—internet media needs to echo reality. We&#8217;re moving in the right direction—bloggers and citizen journalists are multiplying. More people worldwide are gaining internet access. Northern Europe and North America currently have the highest per capita internet usage. Global access is accelerating.</p>
